As journalists especially, writers know that word choice matters. The article clearly presents that the administration is violating the Privacy Act of 1974 and other laws. That's the analysis. "May Have" is softening, it hedges, it tries to weasel out of saying what's substantiated—and it is therefore flat wrong. Instead, the word should be "Has."
